1. Legal capacity

Holi is provided by Okii SAS. By creating an account or using the service, you represent that you have the legal capacity to enter into a binding agreement and to comply with these terms. If local law restricts your ability to use a service of this kind, you are responsible for complying with the laws that apply in the country or territory from which you access Holi.

You also represent that you are not legally prohibited from using the service and that you have not been disqualified from doing so by a competent authority. Where use by minors is permitted by applicable law, responsibility for that use belongs to the relevant parent, guardian, or legal representative.

2. Access and permitted use

Holi may use third-party sign-in methods such as Google or Facebook and may request access to profile information authorized by you. Information received through those services is handled in accordance with this document and the permissions you grant.

You may use Holi only for lawful purposes and in a manner consistent with the features and social purpose of the service. You must not use Holi to commit unlawful acts, facilitate abuse, infringe third-party rights, or interfere with the operation of the application or website.

Holi may change, update, maintain, suspend, or discontinue features from time to time. Temporary interruptions, maintenance, software updates, or technical issues may affect availability. Okii SAS does not guarantee uninterrupted access or that data will never be lost.

3. User content

You are responsible for the information and materials you share through Holi, including profile details, messages, photographs, videos, and other content, whether shared publicly or privately.

You represent that information you provide is accurate to the best of your knowledge and that you have the rights and permissions necessary to share any content you upload. Holi may review, moderate, restrict, or remove content that it reasonably believes violates these terms, applicable law, or the safety and integrity of the service.

By posting or submitting content through Holi, you grant Okii SAS and its service providers a license, to the extent necessary to operate the service, to host, store, reproduce, display, process, and distribute that content as required to provide Holi's features.

4. Prohibited content and conduct

Users must not upload, transmit, request, promote, or distribute content or engage in conduct that is illegal, threatening, harassing, exploitative, defamatory, abusive, obscene, deceptive, or that violates another person's privacy, intellectual property, or other rights.

Without limitation, prohibited conduct includes:

• Impersonating another person or misrepresenting your identity.
• Harassing, threatening, coercing, or exploiting another user.
• Soliciting money, extorting users, or conducting unauthorized commercial activity.
• Sharing pornography, hateful content, racist or sexist content, or material that attacks human dignity.
• Uploading another person's photo, video, audio, or copyrighted material without appropriate permission.
• Uploading or requesting sexual content involving minors.
• Using Holi to facilitate unlawful activities.
• Sending spam, unsolicited bulk messages, malware, viruses, or code designed to damage or disrupt systems.
• Collecting usernames, email addresses, or other user information for unauthorized purposes.
• Reverse engineering, modifying, selling, distributing, or otherwise misusing the software or intellectual property used by Holi.

Okii SAS may investigate suspected violations and may suspend or terminate access where it reasonably believes these rules have been breached.

5. Account duration, suspension, and termination

These terms remain in effect while you access Holi or maintain an account. You may stop using the service at any time. Okii SAS may suspend or terminate an account where it believes these terms have been violated, where required by law, or where necessary to protect users, the service, or third parties.

Following suspension or termination, provisions that by their nature should continue to apply—including intellectual property, liability, dispute resolution, and privacy obligations—may survive termination.

6. Account security and interactions with other users

You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account. You should notify support@holiapp.live promptly if you believe your account or credentials have been compromised.

Interactions with other users are your responsibility. Holi does not guarantee the identity, background, accuracy, intentions, or behavior of any user. Use appropriate judgment and safety precautions when communicating with or meeting another person, especially when moving a conversation outside the service.

You should avoid sharing sensitive financial or identity information such as bank details, card numbers, government identification numbers, home address, workplace address, or other information that could expose you to fraud or physical risk.

7. Intellectual property

The Holi application, website, trademarks, logos, software, interface, graphics, text, and other proprietary materials are owned by or licensed to Okii SAS and are protected by applicable intellectual-property laws. Except as expressly allowed, users may not copy, extract, reproduce, adapt, distribute, or commercially exploit those materials without prior authorization.

8. Subscriptions, trials, and payments

Holi may offer optional paid products, subscriptions, or promotional trial periods. Pricing, billing frequency, and renewal terms are presented when a purchase is made through the applicable app store or payment channel.

Where a subscription renews automatically, it will continue until canceled in accordance with the rules of the applicable store or payment provider. Users are responsible for canceling before the applicable renewal deadline if they do not wish to be charged again.

Except where required by applicable law or by the rules of the relevant app store, unused services, subscriptions, or account time are not automatically refundable when an account is closed or canceled.

9. Disclaimers and limitation of liability

Holi is provided on an “as available” basis to the extent permitted by law. Okii SAS does not guarantee that user-provided information is accurate, that interactions will be safe or successful, or that the service will always be available without interruption or error.

To the maximum extent permitted by applicable law, Okii SAS, its affiliates, branches, partners, employees, and service providers are not responsible for losses or damages arising from user content, user conduct, third-party behavior, communication failures, technical outages, internet-provider issues, device malfunction, malware, or the use of information shared by users.

Holi may contain links, advertisements, or promotions provided by third parties. Okii SAS is not responsible for the content, policies, or performance of third-party services.

10. Governing law and dispute resolution

These terms are governed by the laws of Colombia. If a dispute relating to the formation, interpretation, performance, use, or termination of this agreement cannot be resolved directly, the parties agree that it may be submitted to arbitration in accordance with Colombian law.

Where arbitration applies, the proceeding will be administered through the Arbitration and Conciliation Center of the Chamber of Commerce of Bogotá, decided in law, and conducted in accordance with the applicable Colombian arbitration framework, including Law 1563 of 2012 and related procedural rules.

11. Changes to these terms

Okii SAS may update these terms from time to time. Updated terms may be published on holiapp.live and become effective in accordance with applicable law. Continued use of Holi after an update may constitute acceptance of the revised terms where legally permitted.

12. Privacy Policy

Okii SAS is committed to protecting personal information submitted through Holi. Depending on the features you use and permissions you grant, Holi may process information such as your name, email address, profile description, gender, preferences, interests, date of birth, education, employment details, relationship information, photographs, device information, and location data.

When you use a third-party sign-in service such as Google or Facebook, Holi may receive information that you authorize that service to share. Location information may also be requested when necessary to provide discovery and location-based features.

Purposes of processing

Personal information may be processed to:

• Create and manage your account.
• Provide Holi's products and services.
• Enable matching, discovery, messaging, and related application features.
• Communicate service information and important changes.
• Improve service quality and conduct internal product or usage research.
• Protect users, prevent fraud, enforce these terms, and comply with legal obligations.

Colombian data-protection rights

Personal-data processing is subject to applicable Colombian data-protection law, including Law 1581 of 2012, Decree 1377 of 2013, and related regulations. Users may request access, correction, updating, deletion, or further information about their personal data where those rights apply.

Requests concerning personal data may be sent to support@holiapp.live. To help process a request, include sufficient information to identify you, the nature of your request, and a means of receiving a response.

Security and storage

Holi uses administrative, technical, and organizational safeguards intended to protect personal information. No method of storage or transmission can be guaranteed to be completely secure, so users should also take care when sharing information online.
